Permitting Updates and Resources
Chapter 102 Updates
New NPDES Forms
The PA DEP has updated many of the Chapter 102 forms last year. Over 95% of Wayne County is considered to be in a Special Protection Watershed, so most NPDES applications will require an Individual Permit Application. A summary of these updates can be found here.
The updated forms required to be used or submitted on or after December 8, 2024 include:
- PAG-02 Notice of Intent(Usually not applicable to projects in Wayne County)
- Chapter 102 NPDES Annual Report
- Chapter 102 Visual Site Inspection Report
- Erosion Potential Analysis Form
- New Property Owner Notification Form
- SCM Construction Certification Form
The updated forms required to be used or submitted on or after March 8, 2025 include:
- Permit Application Form
- Modules 1, 2, 3, and 4
- Pre-development Site Characterization(PDSC) Spreadsheet
- Managed Release Concept Spreadsheet
- Notice of Termination
We encourage applicants to always get their forms from the PA DEP website to ensure they're using the most up to date forms. Some of the forms have updated requirements that differ from the older forms, so we encourage applicants to become familar with the updated requirements at the earliest stage in the development of the project and application.

New Notice of Termination Forms and Requirements
Starting March 8, 2025 the updated NPDES Notice of Termination Form will be required when applying to terminate a permit. Along with the updated form there is an updated procedure for the permit termination process and required documents. A training on the Clean Water Academy for the new NOT process can be found here.
Visual Site Inspector Qualification Requirement
The following applies starting December 8, 2025 to PAG-02 permitted sites and new projects receiving Individual Permits and existing projects when the permit is renewed or undergoes a major amendment. Site inspections must be performed and Visual Site Inspection Reports must be completed by qualified personnel that are trained and experienced in E&S and PCSM BMP construction, function, and maintenance and are familiar with the E&S and PCSM Plans for the project site. This is required to be done weekly and after each measurable rain event on all NPDES permitted sites.
A person is qualified when one or more of the following conditions are satisfied:
(i) They have completed the Qualified Site Inspector Training Program in DEP’s Clean Water Academy initially and every two years thereafter;
(ii) They hold active certification as a Certified Professional in Erosion and Sediment Control (CPESC) or as a Certified Erosion, Sediment, and Stormwater Inspector (CESSWI) from a recognized organization; or
(iii) They can demonstrate to the satisfaction of DEP/CCD that they have qualifications equivalent to or exceeding those identified in Paragraphs (i) or (ii). If this option is selected, the person must submit documentation of their training and experience to DEP/CCD and receive written approvalfrom DEP/CCD prior to conducting site inspections, unless waived by DEP/CCD.
